This article presents a legal analysis of industrial design cancellation lawsuits in Indonesia, focusing on weaknesses in the current regulatory framework particularly the ambiguous definition of “novelty.” Using a normative legal approach, it examines relevant statutes, court decisions, and academic literature. The case study of PT Lintas Promosi Global illustrates how the absence of substantive examination during registration can harm original designers, as designs lacking novelty criteria still receive legal protection. This issue arises from weak verification mechanisms and limited public access to design databases. The article calls for legal reforms, including mandatory substantive examination before registration and improved accessibility to design data. These reforms aim to strengthen legal protection, reduce disputes, and support a fair and transparent intellectual property system within Indonesia’s creative economy.
