Abstract

This research examines the urgency of trademark registration as a basis for legal protection to ensure healthy business competition in Indonesia. Intellectual Property Rights (IPR) issues are crucial in the global trade era, especially in maintaining healthy business competition and preventing unfair practices such as imitation, piracy, or unauthorized use of IPR. Despite existing regulations, trademark infringements still occur frequently, harming brand owners and disrupting healthy business competition. The purpose of this study is to analyze the urgency and legal benefits of trademark registration for businesses and its role in creating healthy business competition. The research method used is normative juridical with a library research approach, analyzing written documents in the form of secondary data, including primary, secondary, and tertiary legal materials. The results show that trademark registration is crucial as it provides exclusive legal protection to trademark owners in accordance with Indonesia's "first-to-file" system. Without registration, there will be no legal protection if the brand is plagiarized. Registration also increases consumer confidence, investment security, and facilitates marketing. This research recommends trademark registration as a strategy for legal protection and enhancing the competitiveness of businesses.
